Thailand has introduced a major tax benefit for people who earn money from cryptocurrency and digital tokens. The new rule gives eligible individuals a personal income tax exemption on certain gains from the sale or transfer of crypto assets.
The exemption applies when the transaction takes place through a licensed digital asset business in Thailand. This means the tax benefit does not apply to every crypto deal. The platform and the type of transaction both matter.
The special tax period starts on January 1, 2025, and ends on December 31, 2029. For eligible transactions within this period, the personal income tax rate on the covered gain is effectively 0%.

The New Rule Comes From Ministerial Regulation No. 399
Thailand made the change through Ministerial Regulation No. 399. The Ministry of Finance issued the regulation in 2025, and it was published in the Royal Gazette on September 5, 2025.
The new regulation changes Ministerial Regulation No. 126, which contains several rules on personal income tax exemptions. The Revenue Department lists the new measure as part of Thailand’s plan to promote the country as a global digital asset hub.
The rule covers income from the transfer of cryptocurrency and digital tokens when the required conditions are met. The exemption applies to income received from January 1, 2025, through December 31, 2029.
Who Can Get The Tax Exemption
The main group covered by the measure is individual taxpayers. The rule concerns gains from the sale or transfer of cryptocurrencies and digital tokens.
A very important condition is the use of a licensed Thai digital asset business. The transaction must take place through a licensed digital asset exchange, a licensed digital asset broker, or a licensed digital asset dealer.
PwC confirms that the exemption covers capital gains from crypto and digital token transfers through these licensed channels.
This condition is important because the same crypto asset can have a different tax result based on where the transaction takes place. The tax benefit is not simply based on owning Bitcoin, Ether, or another digital asset. The transaction must also meet the rules for the exemption.
What Is A Crypto Capital Gain
A capital gain is the profit made when an asset sells for more than its purchase cost.
For example, a person may buy crypto for $20,000. Later, that person may sell the same assets for $35,000 through a licensed Thai exchange. The difference is a $15,000 gain.
If the person meets all the conditions under Thailand’s new rule, that gain can receive the personal income tax exemption.
The rule does not make the original purchase tax free. It concerns the gain from a sale or transfer that meets the required conditions. The purchase cost and sale value still matter when a person works out the amount of the gain.

Not All Crypto Income Is Tax Free

Income from crypto mining, staking, airdrops, and reward-based activity can fall outside the capital gains exemption. These forms of income are different from a normal profit from the sale or transfer of an asset.
For example, a person who buys Bitcoin and later sells it at a higher price has a type of income that can fall under the new capital gains rule. A person who receives crypto as a staking reward has a different type of income.
Forvis Mazars notes that the exemption does not cover transactions through unlicensed or foreign exchanges under the stated rules. The relief is tied to digital asset operators licensed by the Thai Securities and Exchange Commission.
